The rollout that matters for SMEs: - Since 2 February 2025: Art. 5 (prohibited practices) and Art. 4 (AI literacy) apply. - Since 2 August 2025: obligations for general-purpose AI model providers (these fall on the model provider, not on the SME that merely uses AI). - From 2 August 2026: national authorities gain enforcement powers (Spain: AESIA; Germany: Bundesnetzagentur), and Art. 50 transparency duties apply (chatbot disclosure, AI-content labelling, deepfake labelling). - 2 December 2027: high-risk obligations for Annex III stand-alone systems (postponed by the Digital Omnibus). - 2 August 2028: high-risk obligations for AI embedded in regulated products (Annex I, also postponed). Art. 4 specifics: every provider and deployer of AI systems must ensure a sufficient level of AI literacy in its staff. The Digital Omnibus (political agreement of 7 May 2026) framed it as an obligation of means, not of result; the duty itself remains. The AI Act sets no specific fine for Art. 4 (sanctions are left to the Member States), but the duty is enforceable from 2 August 2026. The headline fines of the AI Act apply to other breaches: up to €35 million or 7% of worldwide turnover for prohibited practices (Art. 5), up to €15 million or 3% for provider/deployer obligations, and GDPR fines (up to €20 million or 4%) apply independently. Any company whose staff uses ChatGPT, Copilot, Gemini or similar tools falls under Art. 4; there is no minimum company size. Deployer duties for SMEs that use AI in sensitive processes (Art. 26, from December 2027 for Annex III systems): follow provider instructions, ensure human oversight, control input data, retain logs at least 6 months, report serious incidents, and inform workers' representatives before deployment. ## EU AI Act training (Intellecto Academy) Freshlab's turnkey Art. 4 AI literacy training, delivered through the Intellecto Academy platform (built on kAIra, hosted privately in the EU): - Price: EUR 20 per participant, VAT excluded, all-inclusive, from a single participant, no minimum commitment. Available in English, German, Spanish and Danish. - Evidence: named certificates plus a cryptographically signed audit dossier (Ed25519 signature, SHA-256 hash-chained event log) with an offline viewer and a reproducible verification script. The proof stays verifiable for decades without vendor lock-in. Personal data is erased 90 days after dossier handover. - Reaching everyone: HR can print personalised A4 cards with a QR code, a 4-word address and a 6-digit PIN, so production workers, shift staff, temps and cleaning teams without a corporate email can be trained at a shop-floor kiosk or on their own phone, in their native language. - Germany-specific: GDPR and BDSG compliant and works-council friendly. The service is marketed as "Análisis de visibilidad en IA" (ES), "KI-Sichtbarkeitsanalyse" (DE), "AI Visibility Analysis" (EN) and "AI-synlighedsanalyse" (DA). How the measurement works: query batteries are written natively per language, not translated, and are sent through the official APIs of ChatGPT (OpenAI), Gemini (Google), Claude (Anthropic), Grok (xAI) and Perplexity, always with web search or grounding enabled. Default models are the cheaper tiers, because they come close to what a free user sees. Most queries deliberately do not contain the brand name, otherwise the run would measure self-confirmation instead of visibility. Every query is repeated so results can be expressed as frequencies rather than single screenshots. No scraping of consumer web interfaces and no circumvention of access restrictions. The three metrics are reported separately, never merged into one number, because each level fails for a different reason and is fixed by a different measure: - Mention: does the model write the brand name in the answer. If not, the models do not know the entity; the fix is entity foundation work, consistent self-description, Schema.org markup, directory listings and third-party sources. - Citation: does the model cite the brand's own domain as a source. If not, the site is either not reachable for AI crawlers or not citable; the fix is crawler access, rendering without JavaScript, answer-format content and publishing own data. - Recommendation: is the brand recommended positively rather than mentioned in passing. If not, proof is missing; the fix is reviews, published case studies, press work and handling negative mentions. Every analysis starts with a technical website check: AI crawler access in robots.txt and meta directives (GPTBot, ClaudeBot, PerplexityBot, Google-Extended and others; unintentional blocking is the single most frequent finding), structured data and its required fields, readability without JavaScript, entity consistency across pages, language versions and hreflang, answer-format content and content freshness. The report also lists which source domains the models actually cite in that sector, which is the practical target list for the follow-up work, compares the brand against its competitors, and flags false statements the models make about the brand. Packages, each quoted individually rather than by list price: Snapshot (initial diagnosis, reduced battery, one language, short report and call), Deep Dive (full battery, several languages, all five platforms, competitor comparison, source ranking, 90-day action plan), Deep Dive with implementation (the analysis plus the technical fixes, content, markup, listings and press work), and a monthly monitoring retainer (same versioned battery, trend against previous runs, alert when a new competitor appears). What separates the service from subscription monitoring dashboards: those deliver a dashboard and stop there, and they assume the client has a marketing department. Freshlab targets SMEs without one, delivers interpretation and a prioritised plan instead of raw numbers, and carries out the resulting work in house, in Spanish, German, English and Danish. Methodology and liability, stated in every report: what is measured are mention frequencies under defined and documented conditions (a specific battery version, specific models, a specific point in time, web search enabled).
